Terms of Sale and Information About Tosti’s Fine Art Prints
All works sent through a delivery service by the artist to the purchaser, are fully guaranteed by the artist, however, such guarantee is limited to a seven-business-day period commencing upon the actual receipt at the purchaser’s designated shipping address, and to qualify for a refund of the purchase price, the purchaser must (at their expense) return the print to the artist in its full original packaging. Otherwise, the sale is final. If the art work is damaged in transit, a replacement print can usually be provided in lieu of a refund. (In such a case, the artist will pay for the delivery of the replacement print.)
Most sales are of what are called “Limited Edition Original Prints.” Each Original Print bears the serial number of the Print and the maximum number of prints allowed in the Edition.
Tosti severely limits the number of prints in each of his Limited Editions: each Edition’s defined maximum print total is very small, often involving five or fewer impressions. The artist also avoids parallel editions of the same or similar images. Accordingly, no secondary editions based on size variations exist. Nor are so-called “trial proofs” (intermediate attempts to reach a final result) offered. Likewise, no so-called “artist’s proofs” are typically designated. Further, in some cases, artistic variations are introduced among the prints in a particular edition to make each impression distinct. Such variations may include differences in color, density, bordering, cropping, paper selection, and overall size.
Each Original Print is accompanied by a true Certificate of Authenticity, containing important details of the work, such as its title and the date that any predicate, such as a film negative, was created. The Certificate is a necessary part of the provenance supporting the respective work’s value. The artist should be informed in the event that the authenticity of his work (or a work purporting to be his) is at issue, especially if it was not purchased directly from or through the artist or his representatives.
Typically, the Prints are sold unframed and without mat, facilitating the purchaser’s inspection upon receipt. The packaging containing an artwork is designed for delivery purposes and should not be relied on as a substitute for full archival storage.
The sale of an Original Print does not transfer any of the rights in Copyright, which are fully retained by the artist. An Edition’s stated maximum does not imply that the total allowable number of prints exists: an artist may print less, but not more, than the maximum. And the serial number of the Print may or may not reflect the actual order of printing. All Prints are made by or under the direct authority of the artist.
